The Holiday Bakery is the free loyalty program of House of Holiday, Inc. ("House of Holiday," "we," "us"), 90-02 Atlantic Avenue, Ozone Park, NY 11416. Members earn Gumdrops on purchases and trade them for money off at our store and at houseofholiday.com.

By taking part in the program, you agree to these terms. We kept them as short and plain as we could, because nobody should need a lawyer to enjoy a gingerbread man.

Becoming a member

• Membership is free and automatic. You become a member the first time you shop at houseofholiday.com, or when you give us your contact information at the register in our store.
• Your membership is the same in the store and online, so your Gumdrops follow you to both.
• We match your store and online purchases using your email address and phone number. If you shop with a different email or number, let us know and we will combine your accounts.
• One membership per person. Memberships are personal and cannot be sold, transferred or combined with someone else's.
• Prefer not to take part? Contact us and we will close your membership.

Earning Gumdrops

You earn 1 Gumdrop for every $1 you spend at House of Holiday, in the store or at houseofholiday.com. Gumdrops are based on your order subtotal after discounts and coupons, before tax and shipping, rounded down to the nearest whole dollar.

From time to time we may run promotions with extra Gumdrops, such as double Gumdrops. The details of each promotion will be shown when it runs.

Gumdrops are earned only on purchases made in our store or at houseofholiday.com. You do not earn Gumdrops on gift card purchases, tax, shipping and handling, or credit card fees.

When your Gumdrops are ready

Gumdrops need a short time to cool. They become available to redeem on the calendar day after you earn them.

During some promotions, Gumdrops may take a little longer to become available. When that happens, the promotion's own terms will explain it.

Tiers

Your tier is based on how much you have spent with us in the past 12 months, counted the same way as Gumdrops (subtotal after discounts, before tax and shipping). Everyone earns Gumdrops at the same rate in every tier.

• You move up as soon as your 12-month spend reaches the next tier.
• Spending is counted on a rolling 12 months. If your spend over the past 12 months drops below your tier's threshold, your tier moves down to match. Gumdrops you already earned stay yours.
• Each tier bonus is given once, the first time you reach that tier.
• We may occasionally place members in a tier by invitation.

Redeeming Gumdrops

Trade your Gumdrops for a reward coupon. It pays to let your Gumdrops pile up: the bigger the jar, the sweeter the reward.

• Redeem online in your Holiday Bakery account, or ask us at the register.
• Reward coupons work in our store and at houseofholiday.com, and cannot be used to buy gift cards.
• Each reward coupon can be used once and expires 90 days after it is issued.
• If your order total is less than the coupon value, the difference is not refunded or carried over.
• Gumdrops and reward coupons have no cash value. They cannot be exchanged for cash, store credit or gift cards, and cannot be sold or transferred.
• Once Gumdrops are traded for a coupon, the trade cannot be reversed. An unused coupon that expires is not turned back into Gumdrops.
• On occasion we may add other rewards, including free items.

Referring friends

Every member gets a personal referral code to share.

• Your friend enters your code at checkout online, or gives it to us at the register, on their first purchase with House of Holiday.
• Your friend gets 50 bonus Gumdrops for using your code, plus the usual 50 Gumdrop welcome gift and Gumdrops on their purchase.
• You get 100 Gumdrops once your friend's first purchase is complete and has not been returned or cancelled.
• Referrals only count for new customers who have never shopped with us before, in the store or online.
• You cannot refer yourself, a second account of your own, or someone in your household.
• Referral codes are for sharing with people you know. Posting codes on coupon or deal websites is not allowed, and we may cancel referral rewards earned that way.

When Gumdrops expire

Gumdrops expire 18 months after the day you earn them if you have not used them. When you redeem, your oldest Gumdrops are used first, so the ones closest to expiring always go first.

You can check your balance any time in your Holiday Bakery account online, or ask us at the register.

Returns, adjustments and fair play

• If you return or cancel all or part of an order, we remove the Gumdrops you earned on it. This can make your balance go below zero until you earn more.
• If you return an order that was paid in part with a reward coupon, the coupon is not reissued and the Gumdrops used for it are not restored. Your refund covers what you actually paid.
• If Gumdrops are added to your account by mistake, we may remove them.
• If we believe an account is being misused, for example through fake accounts, self-referrals, reselling rewards or any other kind of fraud, we may remove Gumdrops, cancel rewards, or close the account.
• If you think your balance is wrong, contact us within 90 days and we will look into it.

The fine print

Emails about your account. As a member you will receive account updates by email, such as your Gumdrop balance, reward coupons and when they expire, and tier changes. These are sent even if you have unsubscribed from our marketing emails. Other program emails, like welcome notes and reminders, follow your marketing preferences, and you can unsubscribe from them any time.

Your information. We use your information to run the program as described in our Privacy Policy.

Changes to the program. We may change these terms, the earning rates, rewards or tiers, or end the program. We will give at least 30 days' notice by email or on our website before any change that reduces Gumdrops you have already earned. If the program ends, you will have at least 30 days to redeem your remaining Gumdrops.

Closing your membership. You can leave the program any time by contacting us. Any Gumdrops left in your account are forfeited when it closes.

The rest. These terms are governed by the laws of the State of New York. Where a law does not allow part of these terms, that part does not apply and the rest still does. The program is void where prohibited.
